Terms of Sale

These terms govern the vehicle sourcing and supply services provided by K's Kar Sourcing ("we", "us") to you. Please read them before instructing us. Submitting an enquiry does not create a contract — a contract is formed only when we confirm an instruction in writing and you accept the agreed fee or vehicle price.

1. Our service

We source vehicles to a client brief and we offer selected vehicles for sale directly. Where we act as a sourcing agent, we search the trade, auction and private markets on your behalf, inspect and appraise candidate vehicles, negotiate on price, and arrange handover. Where we sell a vehicle directly, we are the seller of that vehicle.

Everything shown on this website — including listed vehicles, prices and specifications — is an invitation to enquire, not a binding offer. Availability, price and specification are confirmed in writing before any commitment.

2. Quotes, fees and deposits

We confirm our sourcing fee or the vehicle price in writing before you commit. Unless we state otherwise, quoted figures include VAT where applicable and exclude road tax, registration transfer, insurance and delivery, which are quoted separately.

Where a deposit is required to begin a search or reserve a vehicle, the amount and whether it is refundable will be stated clearly in writing at the time. A quote remains valid for the period stated in it, or 14 days if no period is given.

3. Payment

Payment is due by bank transfer to the account named on our invoice, in cleared funds, before a vehicle is released or delivered unless we have agreed otherwise in writing. We will never change our bank details by email at short notice — if you receive such a request, call us on 07919 162071 before sending any money.

Title to a vehicle passes to you only once we have received payment in full. Risk in the vehicle passes to you on collection or delivery.

4. Vehicle condition and inspection

Used vehicles are sold as described and, unless expressly stated, will show wear and tear consistent with their age and mileage. We carry out reasonable checks including provenance and mileage verification, and we tell you honestly what we find.

You are strongly encouraged to inspect the vehicle, or arrange an independent inspection, before completing. Any description, photograph, mileage figure or specification we pass on from a third party is provided in good faith based on the information available to us.

5. Your cancellation rights

Where you are a consumer and you enter into a contract with us at a distance or away from our premises, you generally have 14 days to cancel under the Consumer Contracts Regulations 2013, starting the day after you receive the vehicle. To cancel, email us at kskarsourcing@protonmail.com. You must make the vehicle available for collection and take reasonable care of it; we may reduce your refund to reflect any reduction in value caused by handling beyond what is necessary to establish its nature and condition.

If you ask us to begin a bespoke search before the cancellation period ends and then cancel, we may charge for the work reasonably done up to that point. These rights do not apply to business customers.

6. Faults and your statutory rights

Where you buy a vehicle from us as a consumer, the Consumer Rights Act 2015 applies: the vehicle must be of satisfactory quality, fit for purpose and as described. If a fault covered by the Act appears within 30 days you may reject the vehicle for a refund; after that, we have the opportunity to repair or replace before a further remedy applies. Nothing in these terms limits your statutory rights.

Any manufacturer or third-party warranty supplied with a vehicle is provided by that third party on its own terms, in addition to your statutory rights.

7. Finance

Where finance is discussed, we introduce you to third-party lenders and brokers. We are not a lender. Any credit agreement is between you and the finance provider on its terms, and approval is subject to its checks. See our finance page for more detail.

8. Liability

We do not exclude or limit liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited. Subject to that, our total liability arising from a contract is limited to the fee or purchase price you paid us under it, and we are not liable for indirect or consequential loss such as loss of profit, loss of use or hire charges.

9. Complaints and governing law

If something goes wrong, contact us first at kskarsourcing@protonmail.com or 07919 162071 and we will acknowledge your complaint within five working days and aim to resolve it within 28 days.

These terms are governed by the laws of England and Wales, and disputes fall to the courts of England and Wales. Your personal information is handled in line with our privacy policy.
